Terms of Service

These Terms of Service ("Terms") govern your access to and use of the website liveyourfullestexperience.com, coaching services provided by LYFE Solutions, LLC, and The Forge software platform.

These Terms are a binding agreement between you and LYFE Solutions, LLC ("LYFE," "Live Your Fullest Experience," "we," "us," or "our").

By accessing our website, applying for beta access, creating an account, using The Forge, purchasing coaching, or otherwise using our services, you agree to these Terms.

If you do not agree, do not use the services.

1. Overview of Services

LYFE currently offers two distinct categories of services.

1.1 Coaching

LYFE provides premium one-on-one human life coaching delivered by the founder or other authorized LYFE representatives.

Coaching may include conversation, goal-setting, reflection, strategy, planning, accountability, behavioral experiments, and personal development support.

Coaching is not therapy, medical care, mental-health treatment, diagnosis, legal advice, financial advice, or any other licensed professional service.

1.2 The Forge

The Forge is a web-based journaling, SMART-goal, and personal intelligence platform.

The Forge allows users to write journal entries, complete guided prompts, create letters, set goals and sub-goals, track progress, and reflect on patterns.

The Forge uses AI to help organize user-written material over time. It may generate summaries, detect recurring themes, surface cognitive or behavioral patterns, identify recurring internal "parts," break down goals, and reflect the user's own material back to them.

The Forge does not diagnose, treat, cure, or prevent any medical or mental-health condition. It is not a therapist, coach, doctor, crisis service, or substitute for human support.

2. Beta Status

The Forge is currently an invite-only, opt-in private beta.

The product is pre-release, under active development, and may contain bugs, errors, incomplete features, inaccurate outputs, design changes, interruptions, data-processing issues, or other defects.

You understand and agree that beta access is provided for testing, feedback, and early use.

The Forge may change, be modified, be suspended, or be discontinued at any time.

Beta access does not guarantee future access, free access, paid access, feature availability, data retention, or commercial launch.

3. Eligibility

You must be at least 18 years old to use LYFE services.

By using the services, you represent and warrant that:

• You are at least 18 years old.
• You have the legal capacity to agree to these Terms.
• You will use the services only in compliance with applicable laws.
• You will provide accurate and current information.
• You will not allow another person to use your account.

We may refuse, suspend, or terminate access at our discretion.

4. No Therapy, Medical Treatment, or Crisis Services

LYFE is not a medical, mental-health, therapy, counseling, psychiatric, psychological, clinical, emergency, or crisis service.

The services are not intended to diagnose, treat, cure, or prevent any disease, disorder, or mental-health condition.

The services are not a substitute for:

• Therapy.
• Counseling.
• Psychiatric care.
• Medical treatment.
• Emergency services.
• Crisis support.
• Medication management.
• Legal advice.
• Financial advice.
• Professional healthcare.

If you have a medical or mental-health concern, consult a qualified professional.

If you are in crisis, in danger, or may harm yourself or someone else, do not rely on LYFE, The Forge, coaching, email, or website communication. Call emergency services immediately. In the United States, call or text 988 for the Suicide & Crisis Lifeline, or call 911 in an emergency.

5. Coaching Relationship

Coaching is a collaborative personal-development service.

Coaching may involve emotionally meaningful topics, but it is not therapy. Coaching does not create a therapist-client, doctor-patient, attorney-client, fiduciary, or other licensed professional relationship.

You are responsible for your own decisions, actions, results, and well-being.

We may provide reflections, questions, frameworks, strategies, exercises, or observations, but you remain responsible for evaluating whether they are appropriate for you.

We may decline, pause, or end coaching if we believe coaching is not appropriate, if your needs exceed the scope of coaching, if safety concerns arise, if there is a conflict, if payment obligations are not met, or for any other reason consistent with these Terms or a separate coaching agreement.

We may recommend that you seek therapy, medical care, legal counsel, financial advice, crisis support, or another professional service.

6. Coaching Fees, Scheduling, Cancellation, and Refunds

Coaching fees, scheduling terms, cancellation policies, rescheduling rights, refund terms, package details, and expiration periods may be described on the website, in a written coaching agreement, invoice, checkout page, or other written communication.

Unless otherwise stated in a separate written agreement:

• Coaching fees are due before services are provided.
• Missed sessions, late cancellations, and no-shows may be non-refundable.
• Coaching packages may expire after a stated period.
• LYFE does not guarantee specific outcomes.
• Refunds are provided only at LYFE's discretion or as required by law.

If these Terms conflict with a signed coaching agreement, the signed coaching agreement controls for that coaching relationship.

7. The Forge Account Registration

To use The Forge, you may need to create an account.

You agree to:

• Provide accurate information.
• Keep login credentials confidential.
• Notify us promptly of unauthorized access.
• Use your own account only.
• Not share your account with others.
• Not attempt to access another user's account.

You are responsible for activity under your account.

8. User Content

"User Content" means journal entries, letters, guided responses, goals, tasks, reflections, feedback, messages, and other content you submit to The Forge or LYFE.

You retain ownership of your User Content.

By submitting User Content, you grant LYFE a limited, non-exclusive, worldwide, royalty-free license to host, store, process, transmit, analyze, display, reproduce, and otherwise use your User Content solely as necessary to:

• Provide the services.
• Operate The Forge.
• Generate AI outputs.
• Track goals.
• Provide user-facing summaries and patterns.
• Maintain security.
• Debug and improve the service.
• Provide support.
• Comply with law.
• Enforce these Terms.

You represent that you have the right to submit your User Content and that your submission does not violate the rights of others or applicable law.

9. AI Processing and Outputs

The Forge uses AI, including third-party AI providers, to process User Content and generate outputs.

AI outputs may include summaries, reflections, labels, patterns, goal breakdowns, suggested tasks, themes, or other generated text.

AI outputs may be incomplete, inaccurate, misleading, biased, or fail to capture important context.

You should not treat AI outputs as professional advice, therapy, diagnosis, medical guidance, legal advice, financial advice, or emergency support.

You are responsible for how you interpret and use AI outputs.

The Forge reflects your own submitted material back to you using software and AI processing. It does not know you fully, cannot understand all context, and cannot replace human judgment.

10. Third-Party AI Provider

You understand and agree that The Forge may transmit User Content to third-party AI providers, currently OpenAI, for processing.

This processing is necessary for AI-powered features.

OpenAI's public documentation states that API data is not used to train or improve OpenAI models unless the customer opts in, and that abuse-monitoring logs may contain prompts/responses and be retained up to 30 days by default.

We may change or add AI providers in the future.

11. Sensitive Content

You understand that The Forge may be used to write about sensitive personal topics.

You are responsible for deciding what to submit.

Do not submit information you are not comfortable having stored, processed, and transmitted to service providers as described in the Privacy Policy.

The Forge is not designed for crisis use. If you are in immediate danger or crisis, seek emergency help.

12. Acceptable Use

You agree not to use the services to:

• Violate any law or regulation.
• Infringe intellectual property, privacy, publicity, or other rights.
• Harass, threaten, abuse, exploit, or harm others.
• Submit unlawful, defamatory, fraudulent, or malicious content.
• Upload malware or harmful code.
• Attempt to gain unauthorized access to systems or accounts.
• Interfere with service operation.
• Reverse engineer or attempt to extract source code except as permitted by law.
• Scrape, crawl, or harvest data without permission.
• Use the services to develop competing AI models or datasets from outputs.
• Misrepresent your identity.
• Share another person's private information without authorization.
• Use The Forge to provide therapy, diagnosis, or medical advice to others.
• Use the services in a crisis or emergency instead of appropriate emergency resources.
• Abuse beta access or attempt to bypass gating, invitations, or access controls.

We may suspend or terminate access for violations.

13. Feedback

If you provide feedback, suggestions, ideas, bug reports, or feature requests, you grant LYFE a perpetual, irrevocable, worldwide, royalty-free license to use, modify, incorporate, commercialize, and otherwise exploit that feedback without compensation to you.

Do not provide feedback if you expect ownership, compensation, or confidentiality unless we have a separate written agreement.

14. Intellectual Property

LYFE owns the website, The Forge software, brand, design, code, systems, workflows, prompts, templates, text, graphics, logos, trademarks, service marks, and other intellectual property, except for User Content or third-party materials.

You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works from LYFE materials except as permitted by these Terms or written permission.

"LYFE," "Live Your Fullest Experience," "The Forge," and related names, marks, and branding are owned by LYFE Solutions, LLC or its affiliates/licensors.

15. User Export and Deletion

Users may request export or deletion of their User Content by contacting legal@liveyourfullestexperience.com.

Deletion requests will be handled as described in the Privacy Policy. We aim to delete or de-identify User Content within 30 days, subject to legal, security, backup, dispute-resolution, accounting, and compliance limitations.

16. Privacy

Your use of the services is also governed by our Privacy Policy.

By using the services, you acknowledge that you have read the Privacy Policy and understand that User Content may be stored, processed, and transmitted to third-party service providers, including AI providers, as described there.

17. Confidentiality

We aim to treat private User Content and coaching communications responsibly and confidentially, subject to the limitations described in these Terms and the Privacy Policy.

However, you understand that:

• The Forge is a software platform, not a legally privileged relationship.
• Coaching is not therapy and does not create therapist-client privilege.
• Communications with LYFE are not attorney-client privileged.
• We may disclose information where required by law, to protect safety, to enforce agreements, to respond to legal process, or as otherwise described in the Privacy Policy.

18. Availability and Changes

We may modify, suspend, or discontinue any part of the services at any time.

We may impose limits on use, storage, access, features, or availability.

We do not guarantee uninterrupted availability, data availability, feature continuity, or error-free operation.

19. Disclaimers

The services are provided "as is" and "as available."

To the maximum extent permitted by law, LYFE disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, security, reliability, and error-free operation.

We do not guarantee that:

• The services will meet your needs.
• Coaching will produce specific outcomes.
• The Forge will identify all relevant patterns.
• AI outputs will be accurate or useful.
• Goals will be achieved.
• Personal, relational, emotional, financial, health, career, or other results will occur.
• The beta product will continue to operate or remain available.

You use the services at your own risk.

20. Limitation of Liability

To the maximum extent permitted by law, LYFE Solutions, LLC, its owners, officers, employees, contractors, affiliates, agents, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or enhanced damages, including lost profits, lost revenue, lost data, emotional distress, personal injury, reputational harm, business interruption, or loss of goodwill arising out of or relating to the services.

To the maximum extent permitted by law, LYFE's total liability for any claim arising out of or relating to the services will not exceed the greater of:

• The amount you paid to LYFE for the services giving rise to the claim in the three months before the claim arose; or
• $100.

Some jurisdictions do not allow certain limitations, so some limitations may not apply to you.

21. Indemnification

You agree to defend, indemnify, and hold harmless LYFE Solutions, LLC, its owners, officers, employees, contractors, affiliates, agents, and service providers from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable attorneys' fees, arising out of or related to:

• Your use of the services.
• Your User Content.
• Your violation of these Terms.
• Your violation of law.
• Your violation of another person's rights.
• Your actions or decisions based on coaching, The Forge, AI outputs, or website content.
• Your misuse of the services.

22. Termination

We may suspend or terminate your access to the services at any time, with or without notice, if:

• You violate these Terms.
• We believe your use creates risk.
• Required by law.
• You misuse the service.
• Beta access ends.
• The service is discontinued.
• We determine that continued access is not appropriate.

You may stop using the services at any time.

Termination does not automatically delete User Content unless you request deletion or we choose to delete content according to the Privacy Policy.

Sections intended to survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, dispute resolution, and payment obligations.

23. Governing Law

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles.

24. Dispute Resolution

Before filing a claim, you agree to first contact us at legal@liveyourfullestexperience.com and attempt to resolve the dispute informally.

If the dispute cannot be resolved informally, disputes will be resolved in the state or federal courts located in Kitsap County, Washington, unless a different dispute-resolution process is required by applicable law or agreed in a separate written agreement.

You consent to the personal jurisdiction and venue of those courts.

25. Changes to These Terms

We may update these Terms from time to time.

If we make material changes, we may notify users by posting updated Terms, changing the effective date, emailing users, requiring renewed acceptance, or using another reasonable method.

Your continued use of the services after changes become effective means you agree to the updated Terms.

For beta users, we may require affirmative acceptance of updated Terms before continued access.

26. Miscellaneous

These Terms, together with the Privacy Policy and any applicable signed agreement, constitute the entire agreement between you and LYFE regarding the services.

If any provision is found unenforceable, the remaining provisions remain in effect.

Our failure to enforce any provision is not a waiver.

You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, restructuring, sale of assets, or by operation of law.
